A man taking an evening walk recently was struck by a vehicle and killed according to the San Bernardino County Sun.
The California Highway Patrol reports that this is not the first pedestrian accident in San Bernardino. In recent years, three people were killed and 80 were injured in pedestrian accidents. Police are investigating this fatal accident; details are not clear as to what happened. Police are trying to determine who was at fault. They are not sure if the pedestrian was trying to cross the road or if the driver was distracted or speeding. California law requires motorists to yield the right-of-way to all pedestrians in crosswalks.
If it is determined that the driver was at fault, he or she may be responsible for the pedestrian's wrongful death. California Government Code Section 911.2 states, "Any personal injury or wrongful death claim against a public entity must be filed within 180 days of the incident." I would suggest the family of this man contact an experienced California Personal Injury attorney to seek justice for the death of their family member. My thoughts and prayers are with this family on their tragic loss.
