A 50-year old man, his wife and their 8-year old daughter were crossing at an intersection the other evening when a suspected drunk driver struck the man and his daughter. The man was taken to a local hospital with critical injuries; his daughter sustained non-life-threatening injuries. The man died the next day.
Officials are investigating the accident to determine what happened. According to reports, the family was crossing against a 'Don't Walk' sign while the driver had a green light. The 26-year old driver was arrested on suspicion of driving under the influence and vehicular manslaughter. Police are looking for witnesses that can shed some light on the accident.
California Vehicle Code Section 23152 states, "It is illegal to operate a motor vehicle under the influence of alcohol and/or drugs. A driver whose act of driving under the influence results in the death of another will likely face vehicular manslaughter charges".
I hope the family of the victim contacts an experienced San Bernardino Personal Injury attorney to discuss filing a wrongful death lawsuit against the at-fault driver - where they can be compensated for damages and medical expenses, plus the loss of a loved one.
