Elder abuse and neglect has become widespread in California and across the United States. It is a serious problem that affects the lives of elderly patients who depend on others for care. According to the National Center on Elder Abuse, between 1 and 2 million Americans age 65 or older have been injured, exploited or otherwise mistreated by someone they depend on for care or protection. In California, elder abuse claims are handled under the Elder Abuse and Dependent Adult Civil Protection Act, which protects elders from physical abuse, neglect, or poor treatment resulting in pain or mental suffering.
Elder abuse also often occurs in nursing homes, where negligence on the part of these providers can result in severe falls, malnutrition, dehydration, ulcers, and in some cases even death. In 1987, Congress passed the Nursing Home Reform Act, which requires each state to issue regulations to protect the rights of nursing home residents.
