When a 77-year old woman got into a vehicle recently, she was not thinking that the vehicle would crash into another car and she would be killed. The California Highway Patrol officials said she was a passenger in a BMW that rolled several times into the desert near Palm Springs after being struck by another vehicle. The 62-year old BMW driver and two other passengers were taken to a local hospital with non-life-threatening injuries - while the 25-year old driver of the other vehicle was not hurt. Officers do not believe the victim was wearing her seat belt.
The accident is under investigation at this time. Investigators have many unanswered questions, such as, "Who caused the crash, did alcohol or drugs play a part, was the victim ejected due to a defective seatbelt?"
If the 77-year old victim was found to be ejected because of a seatbelt defect, the automaker and/or manufacturer can be held liable for the victim's wrongful death.
