Dram Shop Liability Act

Every day there are people seriously injured or killed in auto accidents involving drunk drivers.

A Federal Bureau of Investigation report revealed that more than 1.41 million people were arrested in a given year for driving under the influence of drugs or alcohol. What's worse, it a third of all drivers arrested had prior drunken driving convictions.

Many states hold commercial vendors of alcohol, such as a bar, restaurant or other retail establishment liable for damages to the victim of a drunk driver. This is referred to as 'dram shop liability'.

Dram Shop Rule:

n. a statute (Dram Shop Act) or case law in 38 states which makes a business which sells alcoholic drinks or a host who serves liquor to a drinker who is obviously intoxicated or close to it, strictly liable to anyone injured by the drunken patron or guest. To the contrary, California recently passed legislation specifically banning such strict liability. It is often hard to prove that the liquor bought or served was the specific cause of an accident (such as an automobile crash while driving home), since there is always an intervening cause, namely, the drunk.

Under California Dram Shop liability laws, "If a driver was served too much alcohol at a bar, restaurant or private party, then caused a DUI accident that injured or killed someone, the business establishment or social host can be held liable for compensating the victims".
