How Do Car Recalls Work?

When you spend your hard-earned money to purchase a new vehicle, you expect it to be safe and free of any dangerous situations. Cars are not perfect and anyone who has spent time dealing with various breakdowns can attest to that.

When a widespread vehicular problem that results in a risk for those in the vehicle comes into light, it will be closely scrutinized by the National Highway and Traffic Safety Administration (NHTSA). A variety of engineering errors can cause a defect in a car. The problem is usually concentrated on models that were produced during a certain time period at one specific plant. Not all vehicles are involved.

When enough reports are compiled, the NHTSA will begin an investigation and determine the root of the problem. Next, the findings are made public. If a manufacturer does not force a recall, then the government, through the NHTSA, will initiate one. They are now considered a liability to the public set by the negligence of the manufactures, sometimes causing severe injuries and accidents. If an injury occurs, and caused at the expense of a defective product contact a personal injury lawyer can help you seek compensation for medical bills, loss wages, pain and suffering.

Just about every day you read about a vehicle recall, such as Toyota when it recalled more than 100,000 vehicles for acceleration or another technical problems, or Chrysler when it recalled almost 300,000 of its minivans for defect in side-impact air bags.

Some of the most common types of defects in a recall are:

  • Wiring or leaks that cause fire
  • Accelerators that stick suddenly
  • Loss of control caused by steering parts that break
  • Air bags that deploy late or for no apparent reason

Aside from actually witnessing a fire or random malfunction in your car, you'll be alerted of the defective product via standard or electronic mail. You will be instructed on the best way to handle it. In most cases, drivers are asked to bring their car to the dealer as soon as possible.

If you have been injured by an unsafe or defective product and are considering a products liability lawsuit, you probably have a number of questions and concerns.
